Terms & Conditions

1. These conditions apply to all sales by Thorburn Group Ltd and prevail over any conflicting terms and conditions referred to in the purchaser’s order or in correspondence or elsewhere unless  specifically agreed to in writing by the seller.
2. We reserve the right to amend the price to recover any increase in labour rates and/or material costs which occur between the Estimate date and the completion of contract.
3. Every effort will be made to complete contracts by the forecast date, however the company will not accept liability for loss occasioned by delay.
4. The Estimate is made on the assumption of an accessible level site, clear of obstruction suitable for the operation of heavy vehicles and cranes. We reserve the right to charge extra costs which arise should actual conditions differ from those described above.
5. The company shall not, when collecting or delivering goods at the site be liable for damage to private roadways, main pipes, manholes, weighbridges, bridges or approaches to such premises caused by the weight of the vehicle and load (if any) or the nature of the goods carried. The company will, without prejudice to the above take reasonable precautions to avoid damage if warned by the client or his agent of specific hazards.
6. Foundation sizes quoted are taken to be in normal soil, having a bearing capacity of 150 KN per Sq metre at the depth stated. Any additional costs, caused by encountering ground conditions (contrary to the above) such as rock, running sand, water etc will be charged for on a time and material basis. No Provision is made for the removal or spreading of soil excavated for foundations. The company will not hold itself responsible for any damage done to below ground installation when excavating bases.
7. The title to the goods does not pass until the seller has received full payment for the goods. If the Purchaser fails to make full payment for the goods the seller has the right to enter on the purchaser’s land and sever and remove the goods.
8. Materials delivered to a Customer’s site and not used in the works remain the property of the seller.
9. In the event of an order being placed by the Buyer and subsequently cancelled then compensation can be claimed for the costs incurred by the seller prior to the cancellation.
10. TERMS OF PAYMENT:- Applications will be made for progress as the work proceeds to a value not exceeding 85% of the work done and materials on site. Application for progress payment are due for payment within seven days of the APPLICATION. Final net payment within Fourteen days of the final invoice.

We reserve the right to charge 4% above bank interest on late payments.
